Families living abroad can claim compensation in India for a road accident through the Motor Accident Claims Tribunal, challenge a rejected insurance claim before the Insurance Ombudsman or Consumer Commission, and sue a hospital for negligent treatment as a deficiency in service. Each forum follows a summary procedure, accepts filing through a representative and evidence by video link, and takes income earned abroad into account when assessing loss.
Three specialised forums
None of these claims goes through the slow ordinary civil court. Motor Accident Claims Tribunals in every district decide claims against vehicle owners and insurers under the Motor Vehicles Act, 1988. Consumer Commissions at district, state and national level, under the Consumer Protection Act, 2019, hear complaints of deficient service against insurers, hospitals, banks and builders, with online filing. The Insurance Ombudsman offers a free, lawyer-optional route for individual policy disputes within a monetary ceiling. Choosing correctly among them affects speed, cost and the amount recoverable.
Deadlines
| Claim | File within |
|---|---|
| Motor accident compensation | 6 months of the accident |
| Insurance Ombudsman complaint | 1 year of the insurer's final rejection |
| Consumer complaint (insurance, medical negligence) | 2 years of the cause of action |
| Civil suit for damages | 3 years |
Families abroad often learn the details late. Delay can sometimes be condoned for good reason, but the safest assumption is that the shortest period applies.
How loss is valued
Indian tribunals use a multiplier method for death: the deceased's annual income, increased for future prospects, reduced by personal expenses, multiplied by a factor fixed by age, plus conventional sums. Injury claims add treatment costs, lost earning capacity and non-pecuniary heads. Consumer Commissions borrow the same method in negligence cases. Income earned abroad is accepted if proved by authenticated contracts, pay slips and tax records, and it makes a large difference to the result. See motor accident claims and medical negligence claims.
Insurance refusals
Life insurers most often repudiate on alleged non-disclosure. The Insurance Act bars any challenge to a life policy after three years and, before that, places the burden on the insurer to prove fraud or a material suppression. Health insurers face a similar moratorium. Many refusals do not survive a formal challenge. See insurance claim recovery. Where the policyholder has died, entitlement between nominee and heirs may also need succession documents.
Evidence to secure immediately
In all three types of claim, records created in the first days decide the outcome: the FIR and accident report; post-mortem and hospital records, which a hospital must supply within seventy-two hours of request; the policy and proposal form; and proof of the victim's income and dependants. We collect these in India on your authority while you gather the documents from abroad, which must be apostilled or attested to be used here.

Frequently asked questions
Can a family living abroad claim compensation in India?
Yes. Residence and nationality are irrelevant. Claims are filed through a power of attorney holder or advocate, and claimants give evidence by video link.
Is compensation received in India taxable?
Compensation for death or injury is generally treated as a capital receipt and not taxed, but interest awarded on it is taxable and subject to deduction at source. Life insurance death benefits are exempt.
Can the compensation be sent abroad?
Yes. Amounts awarded to claimants abroad are paid to their NRO accounts and can be remitted within the annual limit with the court order and tax documents.
How long do these claims take?
Ombudsman complaints are often decided within months. Tribunal and consumer cases vary by district, commonly one to three years, with many insurer claims settling earlier.
Do I need the original documents to start a claim?
Copies are enough for assessment. Certified copies and attested overseas documents are needed at filing.
Can a claim be settled without a full hearing?
Yes. Insurers often settle through conciliation or Lok Adalat. Compare any offer with a proper calculation first.
