Title due diligence in India means tracing ownership through registered documents for at least thirty years, confirming there are no mortgages, court cases or acquisition proceedings, and checking that the building has the approvals it needs. An advocate does this from records at the Sub-Registrar, revenue office, municipal body, RERA and the courts, and gives a written opinion on whether the title is clear and marketable.

Why registration alone does not protect you
India follows a system of registration of deeds, not registration of title. The Sub-Registrar records that a document was executed and stamped. Nobody in that office certifies that the seller had the right to sell. The burden of finding out lies on the buyer, and courts expect a buyer to have made reasonable enquiries before claiming to be a bona fide purchaser.
For buyers abroad the usual risks are a seller who owns only a share, an undisclosed loan against the property, land that is agricultural or under acquisition, a building raised beyond its sanctioned plan, and a pending family suit. Each of these is visible in public records if someone looks.
What our due diligence covers
- Chain of title. Every sale, gift, partition, will and inheritance for thirty years or more, checked against certified copies from the Sub-Registrar.
- Encumbrances. The encumbrance certificate, searches on the CERSAI registry for mortgages, and for company sellers the charges filed with the Registrar of Companies.
- Revenue and municipal records. Mutation, record of rights, land-use classification and property tax dues.
- Approvals. Sanctioned plan, commencement and occupancy certificates, and RERA registration for projects.
- Litigation. Searches of district court, High Court and tribunal records against the owners and the property, plus any acquisition or road-widening notification.
- Seller capacity. Whether all heirs have joined, whether a power of attorney holder truly has authority, and whether a minor's share needs court permission.
Points specific to NRI and OCI buyers
Under the foreign exchange rules, NRIs and OCI cardholders may buy residential and commercial property in India without permission, but not agricultural land, plantation property or a farmhouse. A plot marketed as a "farm" or "villa plot" should be checked for its actual land-use entry before anything is paid. Payment must come through banking channels from an NRE, NRO or FCNR account or by inward remittance.
If you are buying from another NRI, tax must be deducted on the sale at the rates for non-residents, which is a different and stricter regime than the one per cent that applies between residents. Our note on TDS on NRI property sales explains this. For the full transaction we also offer end-to-end purchase and sale support.
Verification of inherited and family property
Due diligence is not only for purchases. Before you accept a share under a family settlement, pay a sibling for their portion or spend on construction, it is worth confirming what the family actually owns. We regularly find land that was acquired by the government decades ago, plots already sold by a deceased parent under an unregistered agreement, and holdings where the revenue record still stands in a grandparent's name.
The same search establishes what must be corrected before a sale: missing mutation, an unprobated will, or a legal heir certificate that was never obtained.
What the report tells you
You receive a signed opinion that lists the documents examined, traces the flow of title, sets out every defect or risk found and states plainly whether the title is clear and marketable, clear subject to conditions, or defective. Where defects can be cured we say how: a release from a co-heir, a no-objection from a bank, a rectification deed, regularisation of a deviation. Where they cannot, we tell you to walk away.
Banks financing NRI purchases require a title report from an advocate on their panel. Our report is independent of the seller and the broker, which is its value.
Mistakes that cost NRIs time and money
- Paying a booking amount before the search because the broker says the deal will be lost.
- Treating the seller's lawyer's report or the bank's panel report as independent.
- Checking the building but not the land underneath it.
- Ignoring the land-use entry on plots sold as "farm" or "villa" plots.
A typical situation
A resale flat with a hidden mortgage
A buyer overseas agrees to buy a resale apartment from an individual seller who produces a clean-looking chain of deeds. The search finds no registered mortgage, but a check of the central mortgage registry shows the title deeds were deposited with a bank for a business loan. The transaction is restructured so that part of the price goes directly to the bank against a release letter and return of originals at closing. Without the search, the buyer would have acquired a flat the bank could sell.
Illustration only, based on patterns we commonly see. It is not a real client's case and outcomes depend on the facts.
If you live in...
The Indian law is the same wherever you live. These are the points that differ by where you are.
USA and Canada
Buyers in the US and Canada often purchase unseen through family. Ask for a site visit report with dated photographs as part of the search.
UK and Europe
Before selling inherited land, verify that it was not acquired by the government or sold by an ancestor decades ago; both are common findings.
UAE and the Gulf
Off-plan purchases marketed at Gulf property shows should be checked against the state RERA record and the developer's land title before any payment.

Frequently asked questions
How many years of title should be checked in India?
Thirty years is the accepted minimum, because it covers the longest ordinary limitation period for claims against property. Where the root of title is a government grant or allotment, the original grant is examined as well.
What is an encumbrance certificate?
It is a certificate from the Sub-Registrar listing registered transactions affecting a property over a chosen period, such as sales and mortgages. It does not show unregistered claims, court cases or equitable mortgages by deposit of title deeds, which is why other searches are needed.
Can title verification be done while I am abroad?
Yes. All searches are made in India from public records. You send copies of available documents by email, and the report is delivered electronically with a signed original on request.
Is a RERA-registered project safe to buy without a title check?
RERA registration confirms that the promoter filed documents with the regulator; it is not a certificate of title. Land ownership, mortgages created by the developer and pending litigation still need independent checking.
Can an NRI buy agricultural land in India?
No. NRIs and OCI cardholders cannot purchase agricultural land, plantation property or farmhouses, though they may inherit them. A purchase in breach of this rule is a FEMA contravention.
What happens if a defect is found after I have bought?
Your remedies depend on the defect: a suit against the seller for damages or refund under the covenants in the sale deed, cancellation of fraudulent documents, or a criminal complaint for cheating. Prevention through a prior search is far cheaper.
How much does a title search cost in India?
Fees depend on the city, the age and number of documents and whether court and revenue searches are included. We quote a fixed fee after seeing the property details, with government search charges at cost.
Does title insurance exist in India?
It is available but rarely used for individual purchases. An advocate's title opinion based on a thirty-year search remains the standard safeguard.
