If you live in Malaysia, documents for India are attested at the High Commission of India in Kuala Lumpur, as Malaysia is not a party to the Hague Apostille Convention. Malaysians of Indian origin can inherit ancestral property in India and may qualify for OCI through a parent, grandparent or great-grandparent. Malaysia is a reciprocating territory, so money decrees of its superior courts are executable in India.

Two communities, two sets of questions
Malaysians of Indian origin. Third- and fourth-generation families often know only that a great-grandfather owned land in a village in Thanjavur, Malappuram or Jalandhar. Whether anything can be claimed depends on what the records show today and who has been in possession. We trace the land through the revenue record, reconstruct the line of heirs and advise honestly on whether a claim is viable or has been overtaken by adverse possession and time. Many also seek OCI registration, for which lineage must be proved by documents.
Indian nationals working in Malaysia. Their needs mirror other NRIs: property transactions, family disputes, and compensation or dues after an accident or death.
Signing documents in Malaysia for use in India
Without the apostille system, the route is attestation by the High Commission. Indian passport holders sign before the consular officer. Malaysian citizens generally sign before a Malaysian notary public or Commissioner for Oaths, have the document legalised by the Malaysian Ministry of Foreign Affairs at Putrajaya, and then by the High Commission. Malaysian birth, marriage and death certificates used to prove lineage follow the same chain, with certified translation where they are not in English.
A power of attorney must be stamped in India within three months of arrival. See the attestation guide.

Inheritance and OCI for families of Indian origin
Foreign citizenship does not bar inheritance of property in India, including agricultural land, from a person who was resident there. The practical hurdles are evidentiary: proving descent across three or four generations, with names spelt differently in each document, and showing that the ancestor's title was never transferred. Indian records that help include old revenue entries, school and temple or church records, and ship or emigration registers. See Can an NRI inherit property in India?
OCI eligibility reaches great-grandchildren of a person who was, or was eligible to be, an Indian citizen in 1950. An OCI card simplifies holding, selling and repatriating proceeds of inherited property.
Court orders, tax and working hours
Malaysia is among the reciprocating territories notified under Indian civil procedure, so money decrees of its superior courts can be executed in India. Malaysia taxes on a territorial basis, with rules on foreign-sourced income received in Malaysia that have changed in recent years; Indian tax on Indian property gains applies in any case, deducted by the buyer. Take Malaysian advice on remitting proceeds.
Malaysia is two and a half hours ahead of India; late morning to evening Malaysian time suits calls.

Frequently asked questions
Can a Malaysian citizen of Indian origin claim ancestral property in India?
Citizenship is no bar to inheritance. Whether the claim succeeds depends on proving descent and on whether the property is still in the family's name and not lost by sale, acquisition or adverse possession.
Is apostille available in Malaysia for documents going to India?
No. Malaysia is not a party to the Apostille Convention. Documents are legalised by the Malaysian Foreign Ministry and attested by the High Commission of India.
Am I eligible for OCI if my great-grandfather was born in India?
Yes, in principle. Eligibility extends up to great-grandchildren, provided you can document each link in the chain and no excluded nationality is involved.
Can a Malaysian court judgment be enforced in India?
Yes. Malaysia is a reciprocating territory, so a money decree of its superior courts may be executed in India under section 44A of the Code of Civil Procedure.
How do I find out whether my family still owns land in India?
Give us the village, district and the ancestor's name as spelt locally. We search the revenue and registration records and report what they show.
Which records help prove Indian origin for a Malaysian family?
Ancestors' Indian passports or emigration records, birth and marriage certificates for each generation, and village revenue or school records from India.
Can I visit the land office in India myself?
You can, but searches are quicker through someone familiar with the local language and record system, and can be done without your presence.
