Insurance claim recovery for NRI policyholders and nominees

Insurers reject claims for reasons that sound final and frequently are not. The law limits when a policy can be questioned, and there are three forums that will examine a repudiation without a full civil trial.

Short answer

If a life or health insurance claim in India is rejected, the claimant can first seek review by the insurer's grievance officer, then complain to the Insurance Ombudsman or file a consumer complaint for deficiency in service. Under section 45 of the Insurance Act, 1938, a life policy cannot be called in question on any ground after three years from issue or revival, and within three years only for fraud or a material misstatement that the insurer proves. NRI nominees can pursue all of these from abroad.

After three years a life policy cannot be repudiated at all; before that, the insurer must prove fraud or a material suppression.

Why claims are rejected, and what the law says

  • Non-disclosure of illness. The commonest ground for early death claims. The insurer must show that a fact was material, was known to the insured and was suppressed. Not every past ailment is material, and where the insurer's own doctor examined the proposer the plea is weaker.
  • Policy lapsed. Premium unpaid beyond the grace period. Check whether notice was sent, whether the policy had acquired paid-up value and whether revival was wrongly refused.
  • Exclusions. Suicide within twelve months, hazardous activities, death outside covered circumstances. Exclusion clauses are read strictly against the insurer.
  • Residence abroad not disclosed or death occurring overseas. Policies bought while resident generally remain valid after emigration; the terms decide.
  • Documentation. Missing originals, name mismatches, or disputes between claimants.
  • Delay in intimating the claim, which the regulator has said should not by itself defeat a genuine claim.

Section 45: the three-year rule

As amended in 2015, section 45 of the Insurance Act provides that no life insurance policy shall be called in question on any ground whatsoever after three years from the date of issue, commencement of risk, revival or rider, whichever is later. Within three years, the insurer may repudiate for fraud, or for misstatement or suppression of a fact material to the expectancy of life, but must communicate the grounds in writing and, in the case of misstatement without fraud, refund the premiums. The policyholder is not guilty of fraud if the misstatement was true to the best of their belief or the insurer could have discovered the truth.

A great many repudiations fail this test once it is put to the insurer formally. The Supreme Court has emphasised that the insurer bears the burden of proving deliberate suppression.

Points for NRI policyholders and nominees

A nominee abroad can lodge the claim through the insurer's NRI service channel or an attorney holder, with attested identity documents and, for a death abroad, the foreign death certificate apostilled or attested and translated. Proceeds are paid to an Indian bank account: to NRE if premiums were paid in foreign exchange and the policy terms allow, otherwise to NRO, from which they can be repatriated within limits.

Certain immediate family members named as nominees are "beneficial nominees" under section 39 and take the money as their own; in other cases the nominee collects for the legal heirs, and a succession certificate may be asked for where there is no nomination. Old policies whose proceeds were never claimed are held by the insurer for ten years and then moved to the Senior Citizens' Welfare Fund, from which they can still be reclaimed for a further period.

Health and other insurance

For hospitalisation in India the usual disputes are pre-existing disease exclusions, "reasonable and customary" deductions and denial of cashless treatment. After the moratorium period fixed by the regulator, now five years of continuous cover, a health claim cannot be contested for non-disclosure except for established fraud. Overseas travel and student policies bought in India, and motor own-damage claims, follow the same grievance path. Third-party accident compensation is dealt with under motor accident claims.

Mistakes that cost NRIs time and money

  • Accepting a repudiation letter as final.
  • Missing the one-year period for the ombudsman.
  • Not asking for the documents the insurer relied on.
  • Letting a policy lapse after moving abroad.

A typical situation

Repudiated after four years

A life insurer rejects a death claim alleging that diabetes was not disclosed, though the policy had run for four years. The nominee abroad writes to the grievance officer citing the three-year bar and, when the insurer maintains its stand, complains to the ombudsman, who directs payment with interest.

If you live in...

The Indian law is the same wherever you live. These are the points that differ by where you are.

USA and Canada

Foreign death certificates need an apostille; hospital records from abroad may be asked for.

UK and Europe

Certified copies of the death registration with apostille are accepted.

UAE and the Gulf

Death certificates must be attested by the host foreign ministry and the Indian mission.

Australia, New Zealand and Asia

Online hearings before the ombudsman and consumer commissions suit claimants abroad.

Frequently asked questions

Can an NRI nominee claim life insurance in India?

Yes. The nominee submits the claim form, death certificate, policy document and KYC documents, attested where issued or signed abroad, directly or through an attorney holder.

Can an insurer reject a death claim after three years of the policy?

No. Section 45 of the Insurance Act bars a life insurer from questioning the policy on any ground after three years from its issue, commencement of risk or revival.

My claim was rejected for non-disclosure of a medical condition. Is that final?

No. The insurer must prove the condition was material and knowingly suppressed, within the first three years. Many such rejections are overturned by the ombudsman or consumer commissions.

How do I complain to the Insurance Ombudsman from abroad?

First write to the insurer's grievance officer. If rejected or unanswered for thirty days, file a complaint with the Ombudsman for the insurer's or your Indian address area, online or by post, within one year.

Is a life insurance payout taxable in India?

Death benefits are generally exempt. Maturity proceeds are exempt subject to conditions on premium relative to sum assured and, for recent high-premium policies, to value limits.

Can I recover an old LIC policy of a deceased parent?

Yes. Unclaimed amounts remain payable to nominees or heirs. The insurer's unclaimed-amount search and the policy number, or the insured's name and date of birth, are the starting point.

Can premiums be paid from abroad?

Yes, from NRE or NRO accounts or by remittance; inform the insurer of your change of status.

What interest is payable on a delayed claim?

The regulator requires interest above the bank rate for delay beyond the prescribed period.
