Short answer

A nominee living in Kuwait can challenge a rejected or delayed Indian life insurance claim, including LIC policies, before the insurer's grievance cell, then the Insurance Ombudsman or a consumer commission. Under section 45 of the Insurance Act a life policy cannot be questioned on any ground after three years, and before that the insurer must prove fraud or a material suppression.

How it works from Kuwait

We compare the reason given with the policy terms, the proposal form and the date of issue. Where the policy is more than three years old, the repudiation is usually unsustainable. A reasoned demand goes to the grievance officer; if rejected or unanswered, a complaint is filed with the Ombudsman within one year, or with the consumer commission for larger claims and compensation.

A death in Kuwait is proved by the Kuwaiti death certificate, attested by the Kuwaiti foreign ministry and the Indian Embassy and translated. Proceeds are paid to an Indian bank account of the nominee and can be remitted within the usual limits.

What is different for NRIs in Kuwait

  • One year for the Ombudsman, two for the consumer commission.
  • Ask the insurer for the documents it relied on.
  • Non-disclosure must be of a material fact known to the insured.
