How it works from Kuwait
Send the cheque to your Indian bank for collection before its three months expire. When the return memo arrives, we issue the notice immediately to all known addresses by registered post and courier. If payment does not come, your attorney holder, usually a family member, files the complaint in the court for your bank's branch, with the cheque, memo, notice and proof of the loan.
Your own evidence is given on affidavit attested at the Embassy of India in Kuwait, and cross-examination, if sought, is by video link. Courts may order interim compensation of up to twenty per cent of the amount. If there was no cheque, the remedy is a recovery suit within three years of the due date; check whether any message or part-payment has extended that period.
What is different for NRIs in Kuwait
- The thirty-day and one-month limits are rarely extended.
- Bank transfers from your NRE or NRO account prove the loan.
- A cheque case and a civil suit can run together.
