How it works from the UAE

Courier the cheque to your Indian bank or have your attorney deposit it before its three-month validity ends. On dishonour we issue the notice the same week to every address of the drawer. The complaint is filed in the court for your bank branch, with the cheque, memo, notice and proof of the loan such as bank transfers.

Courts can order interim compensation of up to twenty per cent early in the case, which usually brings the drawer to settlement. Where no cheque was given, a recovery suit must be filed within three years of the loan falling due; a written acknowledgement or part-payment extends that. UAE court judgments are directly executable in India, but for a debtor and debt located in India, suing there is quicker.

What is different for NRIs in the UAE

  • Each cheque has its own deadlines.
  • Transfers from your NRE or NRO account are strong proof of the loan.
  • A settlement cheque that bounces starts a fresh cause of action.

Step by step from the UAE

  1. Free review call

With only ninety minutes between Dubai and India, calls happen in normal office hours. We read your papers on a recovery matter first, so the call is about your options and not a repeat of the facts.

  2. Authority from UAE

Where a representative must act for you in India on a recovery matter, you sign before the consular officer at the Embassy in Abu Dhabi or the Consulate in Dubai, generally through the outsourced attestation centre. We draft the document and send signing instructions.

  3. Work in India

In India, we issue the statutory notice within thirty days of the cheque return memo and file the complaint or summary suit in time. Updates for clients in the UAE go by email and WhatsApp with scans of whatever is filed.

  4. Result and handover

At the end you receive the order and we attach assets or accounts if payment is not made. Originals are couriered to your address in the UAE if you need them.
