NRI legal services for Indians in Kuwait

Kuwait's Indian community runs to several generations of nurses, engineers, traders and domestic workers. Their legal needs in India are practical and urgent, and can be met without leaving Kuwait.

NRI legal services for Indians living in Kuwait with matters in India
Short answer

If you live in Kuwait, a power of attorney or affidavit for India is signed and attested at the Embassy of India in Kuwait City, as Kuwait is not a member of the Hague Apostille Convention. The document is then stamped in India and used by an advocate or relative to act for you in property transactions, court cases, bank matters and inheritance claims.

The matters clients in Kuwait raise

A large part of the community is from Kerala, Andhra Pradesh, Telangana, Tamil Nadu and Goa, with remittances invested in gold, land and housing. Three situations recur. Money lent to a relative or neighbour for a house or a visa has not come back, and limitation is running: a recovery suit or cheque case is needed. A tenant or relative in the family home will not leave: see eviction and possession recovery. Or a share in a parent's property has to be claimed or formally given up.

For workers returning to India for good, we also advise on closing the loop: converting accounts, bringing savings home and regularising property records.

Signing documents in Kuwait for use in India

Attestation of a power of attorney is done at the Embassy, with applications taken through its outsourced service centres. The executant signs in person with passport, Civil ID and photographs. Kuwaiti documents intended for India, such as a death certificate or employer's letter, are first legalised by the Kuwaiti Ministry of Foreign Affairs and translated into English.

In India the power of attorney is stamped within three months. For the full sequence see document attestation.

Deaths, indemnity and legal heirs

When an Indian national dies in Kuwait, end-of-service indemnity, salary arrears, insurance and any court-awarded compensation are released to legal heirs on documents from India. The usual requirement is a legal heirship certificate from the revenue authority or a succession certificate from the court, attested up the chain and legalised by the Kuwaiti mission, with a power of attorney from the heirs. We prepare these, deal with the attestation and liaise with the Embassy's welfare wing. Where a private life policy in India is refused, see insurance claims.

Tax, accounts and working hours

Kuwait has no personal income tax. Your Kuwaiti earnings are not taxable in India while you are non-resident. Indian income is taxable, and from the year you return to India for good your status moves, usually through a "not ordinarily resident" phase, to full resident taxed on worldwide income. NRE and FCNR deposits should be redesignated on return within the rules, and resident foreign currency accounts may be used for savings brought back. See FEMA compliance and income tax.

Frequently asked questions

How do I attest a power of attorney in Kuwait for India?

Apply through the Embassy of India's service centre and sign before the consular officer. Apostille is not available because Kuwait is not a member of the Convention.

I lent money to a relative in India three years ago. Can I still recover it?

A suit must generally be filed within three years of the loan becoming due, extended by any written acknowledgement or part-payment. Check the dates immediately.

What do heirs in India need to claim end-of-service dues from Kuwait?

Usually a legal heirship or succession certificate issued in India and legalised for Kuwait, with a power of attorney. The Embassy guides the transfer of funds.

Is my Kuwait income taxed in India after I return permanently?

Income earned before you return is not. After return you become resident, typically passing through a not-ordinarily-resident period before being taxed on worldwide income.

Can a tenant in my house in India be evicted while I am in Kuwait?

Yes, through a notice and eviction petition filed by your attorney holder under the applicable state rent law.

Can a domestic worker or labourer in Kuwait afford these services?

Many matters, such as heirship certificates and simple powers of attorney, involve modest fixed fees. We state the cost in writing before starting.

Can my family in India receive my case updates?

Yes. With your consent we keep a family member copied on every update.

Is a limitation date approaching?

Tell us when the money was lent or when the problem began. We will check the deadline first.
