A person living abroad can both defend and initiate criminal proceedings in India through an advocate. An accused can obtain anticipatory bail and seek quashing of a false FIR from the High Court without first travelling. A victim can file a complaint online or through a representative and ask for funds to be frozen. Since 1 July 2024 the Bharatiya Nyaya Sanhita and Bharatiya Nagarik Suraksha Sanhita have replaced the Indian Penal Code and Criminal Procedure Code for new cases.
How a criminal case moves
For a cognisable offence the police register a first information report and investigate. They may arrest, though for offences punishable up to seven years a notice to appear is the norm. On completing investigation they file a final report: a charge sheet if there is a case, or a closure report if not. The Magistrate takes cognisance, the accused is summoned, charges are framed and the trial proceeds. For non-cognisable offences and for cheque dishonour, the route is a private complaint directly to the Magistrate. At each stage there is a remedy: anticipatory bail, quashing, discharge, revision.
If you are accused
The pattern we see most is a criminal complaint used as leverage in a matrimonial or property dispute, often naming relatives who live abroad. The response is in three parts: protection from arrest, engagement with the investigation through counsel, and a challenge to the proceedings where they disclose no offence. Courts have long held that criminal process is not a tool for settling civil scores. See FIR quashing and bail and, for matrimonial allegations, domestic violence and cruelty cases.
Never ignore a summons. Non-appearance leads to warrants, proclamation and attachment of property, and from there to look out circulars, passport action and extradition requests.
If you are the victim
Fraud on overseas Indians ranges from forged property documents and misused powers of attorney to investment schemes and online scams. Reporting quickly on the national cyber crime portal can freeze funds in transit. A properly drafted complaint, supported by documents and addressed to the right wing, gets registered where a vague one does not; where police decline, the Magistrate can direct investigation. Recovery then runs through release of frozen money, civil suits and claims against negligent banks. See fraud and cybercrime recovery.
Where the wrong is an unpaid debt backed by a cheque, the section 138 complaint is quicker and carries a presumption in the payee's favour.
Machinery specific to NRIs
Punjab operates NRI police stations in several districts and a State Commission for NRIs with powers to summon and recommend action; Kerala, Gujarat and other states have NRI cells in their police establishments; and the Ministry of External Affairs runs grievance portals for overseas Indians. These bodies do not replace courts, but a complaint through them often produces a faster first response for a complainant who cannot visit a local station. We use them alongside, not instead of, formal legal remedies.
Before you travel
If you know or suspect that a case exists, find out its status before booking: whether an FIR is registered, whether warrants or a proclamation have issued, and whether a look out circular is likely. With that information, anticipatory or transit bail can be arranged and the investigating officer informed, so that arrival is uneventful. This single precaution prevents most airport detentions.

Frequently asked questions
Can I file a police complaint in India from abroad?
Yes. Complaints can be emailed or posted to the police, filed on state online portals or the national cyber crime portal, or lodged by an authorised representative. NRI cells in several states accept complaints directly from overseas.
Can a criminal case in India proceed if I do not attend?
It can lead to warrants and proclamation, and the new procedure code permits trial in the absence of a proclaimed offender in certain cases. Appear through counsel and seek exemption instead of staying away.
What is the difference between quashing and bail?
Bail protects you from custody while the case continues. Quashing ends the case itself, where the High Court finds no offence is made out or the proceeding is an abuse of process.
Are old cases governed by the new criminal laws?
Offences committed before 1 July 2024 are tried under the Indian Penal Code. The new Sanhitas apply to offences committed on or after that date.
Should I talk to the police directly from abroad?
Respond to formal notices through your advocate. Informal calls are best avoided; statements can be given properly when you join the investigation.
Can I be tried in my absence?
The new procedure code permits trial of a proclaimed offender in absence in certain cases, which is a strong reason to appear through counsel.
