Partition of family property in India for NRIs in Canada

Jointly recorded agricultural land is the commonest asset of Canadian families from Punjab and Haryana, and the hardest to turn into money without partition.

Property Partition Suit for NRIs living in Canada, handled in India
Short answer

A co-sharer living in Canada can have agricultural land in Punjab or Haryana partitioned by applying to the Assistant Collector under the land revenue law, and can sue in the civil court for houses and urban plots. Both are done through an apostilled power of attorney. Once your share is separated and recorded, it can be sold or leased independently.

How it works from Canada

Revenue partition has its own stages: application, notice to all co-sharers, a "mode of partition" fixing how the land will be divided, the field book prepared by the Kanungo, and finally the instrument of partition (sanad) and new khasra numbers. Objections about title are referred to the civil court. We attend each stage and keep the file moving, which is most of the battle in revenue offices.

Where a co-sharer has already sold specific fields or built on the best part, we seek an injunction and insist that partition adjust for it. If the family is willing, a registered partition deed or family settlement reaches the same result in weeks; we draft it and your attorney holder signs.

What is different for NRIs in Canada

  • Agricultural land can later be sold only to a resident Indian citizen.
  • Check the jamabandi online first; it shows each co-sharer's fraction.
  • A daughter in Canada has the same share as a son.

Step by step from Canada

  1. Free review call

Calls are fixed for your evening or early morning to overlap with Indian office hours. We read your papers on a partition claim first, so the call is about your options and not a repeat of the facts.

  2. Authority from Canada

Where a representative must act for you in India on a partition claim, you sign before a Canadian notary and obtain the federal or provincial apostille, or attend the Indian mission for your province. We draft the document and send signing instructions.

  3. Work in India

In India, we send the notice for amicable division and, failing that, file the suit with an application to stop any sale of the joint property. Updates for clients in Canada go by email and WhatsApp with scans of whatever is filed.

  4. Result and handover

At the end you receive the decree or registered settlement and we see the division through to the revenue record. Originals are couriered to your address in Canada if you need them.

Questions from NRIs in Canada

How long does partition of land in Punjab take?

An uncontested revenue partition can finish in several months; contested cases with appeals take longer. A family settlement is fastest.

Can I partition land in Punjab while living in Canada?

Yes. Your attorney holder files and attends before the revenue officer, and you sign documents in Canada with apostille.

What if my share was already sold by my uncle?

He could sell only his own share. The buyer takes subject to partition, and your fraction remains yours.
