With heirs spread across Leicester, Birmingham, Nairobi and Ludhiana, agreeing what to do with ancestral land is often impossible without a formal partition.

Short answer

A co-owner in the United Kingdom can obtain partition of family property in India through the revenue authority or civil court, acting by an apostilled power of attorney. Shares are fixed by Indian succession law regardless of British citizenship. If the property cannot be divided, the court can order a sale and distribute the proceeds.

How it works from the UK

The preliminary work is a complete, documented family tree, because every living heir must be a party. We then calculate each share. Where some heirs cannot be traced or will not respond, the court permits service by publication and proceeds. An injunction stops the branch in possession from selling in the meantime.

Many UK families prefer a negotiated buy-out: the relatives in India pay for the shares of those abroad at a valuation, recorded in a registered deed. We arrange the valuation, draft the deed and make sure payment comes through banking channels so it can be remitted to the UK.

What is different for NRIs in the UK

  • Daughters and their descendants are entitled; older oral "settlements" excluding them rarely stand.
  • A UK court cannot partition land in India.
  • Twelve years from open exclusion is the outer limit.

Step by step from the UK

  1. Free review call

Calls fit easily into a UK morning, when courts and offices in India are still open. We read your papers on a partition claim first, so the call is about your options and not a repeat of the facts.

  2. Authority from UK

Where a representative must act for you in India on a partition claim, you sign before a UK notary public or solicitor and obtain the FCDO apostille, or attend the High Commission or a Consulate General. We draft the document and send signing instructions.

  3. Work in India

In India, we send the notice for amicable division and, failing that, file the suit with an application to stop any sale of the joint property. Updates for clients in the UK go by email and WhatsApp with scans of whatever is filed.

  4. Result and handover

At the end you receive the decree or registered settlement and we see the division through to the revenue record. Originals are couriered to your address in the UK if you need them.
