Property transfer and mutation in India for NRIs in the UK

Many UK families discover that land "owned" for fifty years is still recorded in the name of a grandfather who emigrated in the 1960s.

Property Transfer & Mutation for NRIs living in the UK, handled in India
Short answer

From the UK you can bring inherited property in India into the names of the present heirs by mutation, and transfer or release shares within the family, through an attorney holder acting under an FCDO-apostilled power of attorney. Where the recorded owner died long ago, a chain of mutations, one per generation, is usually needed before any sale.

How it works from the UK

We obtain certified copies of the record of rights and trace who is recorded, who has died and who the heirs are at each step. Death certificates from the UK are apostilled; older Indian deaths may need late registration or affidavits. Applications are then made in sequence, each with a notice period. Where a relative in the village has had the land entered in a sole name, the order is challenged before the Collector.

Often the family abroad decides that one member, or the relatives in India, should keep the land. A registered relinquishment deed or family settlement records that properly. For those who intend to sell, clean mutation is what buyers and their banks ask for first.

What is different for NRIs in the UK

  • Mutation is a fiscal entry, but no buyer will proceed without it.
  • Inherited agricultural land can be transferred only to a resident Indian citizen.
  • Check for adverse possession risk if someone else has cultivated for decades.

Step by step from the UK

  1. Free review call

Calls fit easily into a UK morning, when courts and offices in India are still open. We read your papers on a transfer or mutation first, so the call is about your options and not a repeat of the facts.

  2. Authority from UK

Where a representative must act for you in India on a transfer or mutation, you sign before a UK notary public or solicitor and obtain the FCDO apostille, or attend the High Commission or a Consulate General. We draft the document and send signing instructions.

  3. Work in India

In India, we obtain the heirship or title papers, file the mutation application and follow it until the order is passed and the record updated. Updates for clients in the UK go by email and WhatsApp with scans of whatever is filed.

  4. Result and handover

At the end you receive the certified mutation entry and updated tax and utility records. Originals are couriered to your address in the UK if you need them.
