Civil litigation and contract disputes in India from the UK

The UK is one of the few countries whose court judgments India will enforce directly, which changes how a UK creditor should approach a debtor with assets in India.

Short answer

A money judgment of a superior court in the United Kingdom can be executed in India as if it were a decree of an Indian district court, because the UK is a reciprocating territory under section 44A of the Code of Civil Procedure. Alternatively, a UK resident can sue directly in India through a power of attorney holder. The choice depends on where the defendant and assets are.

How it works from the UK

To execute a UK judgment we file a certified copy with a certificate from the UK court stating the extent to which it remains unsatisfied. The Indian court checks that the judgment is conclusive: given on the merits by a competent court, after proper notice, without fraud. Default judgments receive closer scrutiny. Execution then proceeds against bank accounts, salary and property in India.

Where you do not yet have a judgment and the debtor is in India, suing here is usually quicker. Claims on written contracts or cheques can use the summary procedure, and commercial disputes go to commercial courts with fixed timelines. Limitation is generally three years, so check dates before anything else.

What is different for NRIs in the UK

  • Only money decrees qualify; injunctions and penalties do not.
  • Execution must generally be sought within twelve years of the judgment.
  • Arbitral awards made in the UK are enforceable under the New York Convention route.
