How it works from Singapore

For execution of a judgment we file the certified copy with the required certificate in the district court where the debtor has assets. For an award we apply for recognition and enforcement before the High Court. Indian courts also grant interim measures in aid of Singapore-seated arbitration to secure assets.

Where no decision yet exists and the counterparty is Indian, we advise whether to arbitrate, sue in Singapore or sue in India, weighing speed, cost and where the assets are.

What is different for NRIs in Singapore

  • Only money decrees are executable directly.
  • Check limitation: three years for most claims.
  • Draft dispute clauses with enforcement in mind.
