Property transfer and mutation in India for NRIs in New Zealand

Many New Zealand residents do not want their inherited share at all; they want to hand it, properly and finally, to the sibling who stayed in India.

Property Transfer & Mutation for NRIs living in New Zealand, handled in India
Short answer

From New Zealand you can release your inherited share in Indian property to a sibling, or have it recorded in your own name, through an attorney holder. A relinquishment deed is registered in India under a power of attorney, notarised and apostilled by the Department of Internal Affairs, that specifically authorises the release. Mutation of the land or municipal record follows on the registered deed.

How it works from New Zealand

We first confirm who the co-heirs are and have the property mutated in all heirs' names, because you can only release a share that the record shows you hold. The deed is then drafted. Between co-heirs a relinquishment deed is the right instrument and most states charge low stamp duty for it; a gift deed is used where the recipient is not already a co-owner. Your attorney holder signs and registers it before the Sub-Registrar, and we apply for the updated entry.

If instead you intend to keep the share, we apply for mutation with the death certificate and heirship proof and send you the certified record. With courier taking about a week each way from New Zealand, we prepare the power of attorney and any affidavits as one batch so you visit the notary once.

What is different for NRIs in New Zealand

  • A release is permanent; it cannot be undone because relations later change.
  • Agricultural land can be released only to a resident Indian citizen.
  • A power of attorney "to manage" property does not cover a release; the deed must be named.

  2. Authority from New Zealand

We draft the document and send signing instructions.

  3. Work in India

In India, we obtain the heirship or title papers, file the mutation application and follow it until the order is passed and the record updated. Updates for clients in New Zealand go by email and WhatsApp with scans of whatever is filed.

  4. Result and handover

At the end you receive the certified mutation entry and updated tax and utility records. Originals are couriered to your address in New Zealand if you need them.
