Short answer

From Oman you can buy or sell property in India through an attorney holder acting under a power of attorney attested at the Embassy in Muscat or apostilled in Oman. On a sale the buyer deducts tax at non-resident rates unless you hold a lower deduction certificate, and the proceeds can be remitted to Oman up to one million US dollars a year after tax.

How it works from Oman

For a sale we put title papers in order, compute the gain and apply for the certificate before the deed is signed. The attorney holder registers the sale and the price is paid into your NRO account. For commercial property let to a tenant, we also deal with assignment of the lease and deposits.

For a purchase, a title search comes first, then an agreement that fixes price, schedule and remedies. Payment is made from your NRE or NRO account or by remittance from Oman. We keep the money trail documented so that a later sale and repatriation raise no query.

What is different for NRIs in Oman

  • Take the whole price by bank transfer.
  • Agricultural land and farmhouses cannot be bought.
  • With no tax in Oman at present, Indian tax is the cost to plan.

Step by step from Oman

  1. Free review call

Muscat is ninety minutes behind India, so calls happen in normal office hours. We read your papers on a property purchase or sale in India first, so the call is about your options and not a repeat of the facts.

  2. Authority from Oman

Where a representative must act for you in India on a property purchase or sale in India, you sign before the consular officer at the Embassy of India in Muscat, or use an Omani notary with apostille. We draft the document and send signing instructions.

  3. Work in India

In India, we verify title, settle the agreement and sale deed, handle the tax deduction paperwork and attend registration with your attorney holder. Updates for clients in Oman go by email and WhatsApp with scans of whatever is filed.

  4. Result and handover

At the end you receive the registered deed, tax certificates and, on a sale, the bank papers for repatriation. Originals are couriered to your address in Oman if you need them.
