Families with businesses and property in both Oman and India need the Indian assets to pass under a document Indian offices will act on.

Will Drafting & Probate for NRIs living in Oman, handled in India
Short answer

Residents of Oman can make a will for assets in India, signed before two independent witnesses, with attestation at the Embassy of India in Muscat for added weight. A separate Indian will, limited to Indian assets and coordinated with any will made in Oman, is the practical course. After death we obtain probate or letters of administration in India where required.

How it works from Oman

We take instructions by video call, list the Indian properties, accounts and shareholdings as Indian records describe them, and draft a will naming an executor who can act in India. Where shares in a family company are involved, the will is aligned with the articles and any shareholders' agreement.

You sign in Oman before two witnesses who are not beneficiaries. The will can be registered in India on a visit or kept in safe custody. Indian law governs land in India whatever your residence, and Muslim testators can will only one-third without the heirs' consent.

What is different for NRIs in Oman

  • Make sure a will signed in Oman does not revoke the Indian one.
  • Name an alternate executor living in India.
  • Review after any purchase, sale or change in the family.

Step by step from Oman

  1. Free review call

Muscat is ninety minutes behind India, so calls happen in normal office hours. We read your papers on an Indian will or probate first, so the call is about your options and not a repeat of the facts.

  2. Authority from Oman

Where a representative must act for you in India on an Indian will or probate, you sign before the consular officer at the Embassy of India in Muscat, or use an Omani notary with apostille. We draft the document and send signing instructions.

  3. Work in India

In India, we finalise the will for signature before two witnesses, or file the probate petition and take it through citation and evidence. Updates for clients in Oman go by email and WhatsApp with scans of whatever is filed.

  4. Result and handover

At the end you receive the signed or registered will, or the sealed grant for use with banks and registries. Originals are couriered to your address in Oman if you need them.
